1 - LEGAL NOTICE
These General Terms and Conditions of Sale (hereinafter referred to as the “T&Cs”) apply to the website https://manceraparfums.com/civ/. This website is owned by the company PREMIUM DESIGN.
PREMIUM DESIGN is a limited liability company (SARL) with a share capital of 6,500,000 CFA Francs, whose registered office is located at Marcory Zone 4C, Rue du Dr Blanchard, and registered in the Trade Register under number CI-ABIDJAN-03-2023-B12-06020.
The seller is the company PREMIUM DESIGN.
This contract and the T&Cs governing it are subject to Ivorian law.
2 - PURPOSE OF THE T&Cs
2.1 SCOPE OF THE T&Cs
These T&Cs are intended to define, within the scope of the relationships established through the Site, the terms and conditions of online sales of MANCERA products to customers. They outline all the steps necessary for placing an order and ensure the follow-up of this order between the parties.
The T&Cs apply exclusively to online sales of MANCERA products on the website https://manceraparfums.com/civ/, which is freely and openly accessible to any internet user.
These T&Cs, together with the order confirmation, constitute the contractual documents binding on the parties, to the exclusion of all other documents, brochures, catalogs, or product photographs, which are for informational purposes only.
2.2 SCOPE OF APPLICATION OF THE T&Cs
The T&Cs apply exclusively to products delivered to customers located in Côte d’Ivoire.
The T&Cs and all contractual information mentioned on the site are written in French.
2.3 AVAILABILITY AND ENFORCEABILITY OF THE T&Cs
The T&Cs are made available to customers on the seller’s website, where they can be viewed directly.
By placing an order for a product on the site, the customer acknowledges having read and accepted the T&Cs without restriction. This acceptance does not require a handwritten signature from the customer.
Order confirmation implies full acceptance of the T&Cs in force on the date of the order, and the professional seller ensures their storage and reproduction.
2.4 VALIDITY OF THE T&Cs
If any provision of these T&Cs is declared null and void in whole or in part, the remaining provisions and the rights and obligations arising from the T&Cs shall remain unchanged and applicable.
The temporary or permanent non-application of one or more clauses of the T&Cs by the professional seller shall not be deemed a waiver of the remaining clauses, which shall continue to be fully effective.
2.5 MODIFICATION OF THE T&Cs
PREMIUM DESIGN reserves the right to update the T&Cs at any time. However, it is understood that the T&Cs applicable to any order are those accepted by the customer at the time of order validation.
3 - PRODUCTS
3.1 PRODUCT PRESENTATION
The MANCERA products offered for sale are those listed on the Site. They are described and presented as accurately as possible as of the date of consultation of the Site by the customer, and subject to stock availability. PREMIUM DESIGN reserves the right to modify the range of products available for sale at any time.
Each product offered for sale in the online catalog includes a description. Customers are advised to consult the description of each product by clicking on the “composition” link to learn more about the product, especially with regard to the features they are seeking, as the customer is solely responsible for the selection and purchase of a product.

3.2 PRODUCT AVAILABILITY
Products are offered subject to availability. Information about product availability is provided at the time of ordering, on the product page. If, despite the seller’s diligence, the ordered products are no longer available, the seller will inform the customer as soon as possible by any means and may offer a product of equivalent quality and price.
In the event of disagreement, the customer will be refunded no later than thirty (30) days after payment.
No charge will be made to the customer’s bank account for any unavailable product(s).
Any cosmetic product order may be accompanied by free samples, only upon customer request. However, the seller shall not be held liable for the unavailability of such samples.
4 - PRICES
4.1 SALES PRICES
The sales prices are indicated for each product listed in the electronic catalog, in CFA Francs, all taxes included.
The sales price of a product is the one in effect on the day of the order.
In the case of a promotional price, the professional seller agrees to apply the promotional price to any order placed during the promotion period.
4.2 MODIFICATION OF SALES PRICES
The seller reserves the right to change its prices at any time, while guaranteeing the application of the price in effect on the day of the order.
5 - PAYMENT
5.1 PAYMENT METHODS
The full price is payable upon confirmation of the order. The Customer must also pay any mandatory taxes and fees, as well as any potential bank charges, which will always be borne by the Customer. Payment is made immediately upon ordering via the store’s phone or via WhatsApp at +225 07 77 77 39 71.
5.2 PAYMENT SECURITY
Payment will be considered validated once the payment authorization has been confirmed by the issuing institution.
6 - ORDER
6.1 ORDER PROCESS
The Customer is invited to select the desired Products and add them to the shopping cart by clicking the "Add to cart" button. The Customer can view their order summary at any time by clicking on "View Cart". At this stage, the Customer can verify the order details, correct any errors, or remove one or more Product(s).
After validating the cart by clicking "Checkout", the Customer is informed of the delivery and payment methods. The Seller cannot be held responsible for any inaccuracies in the information provided by the Customer.
The Customer account provides access to a personal space where Customers can track their orders and access invoices.
To finalize the order, the Customer must:
• Confirm or enter a new shipping and/or billing address,
• Read and explicitly accept the present T&Cs by checking the box “I have read and accept the T&Cs” before proceeding with payment,
• Then proceed to payment by clicking the “Proceed to payment” button, which opens the secure payment process.
Order confirmation implies acceptance of the T&Cs and constitutes the contract.
The sale is only considered final once the Seller sends an order acceptance confirmation by email to the address provided by the Customer. The Customer formally agrees to receive this confirmation via email from PREMIUM DESIGN.
6.2 ORDER CANCELLATION
Once payment has been made, the Customer cannot modify the order. However, if the order has not yet been processed, the Customer may cancel it by contacting Customer Service via the form at https://manceraparfums.com/civ/, or by phone Monday to Sunday (excluding public holidays) at +225 07 77 77 39 71. All requests are subject to acceptance by the professional Seller.
The Customer may still exercise their right of withdrawal, as outlined in Article 8 below. If so, the Customer will be notified by email of the order cancellation and will be reimbursed for any payments made prior to cancellation.
6.3 ORDER VALIDATION
The Seller reserves the right to refuse any order that appears abnormal, abusive, or contrary to the T&Cs. Likewise, the Seller cannot be held liable if the administrative and/or technical handling of an order is disrupted by a virus, software bug, unauthorized human intervention, or any cause beyond the Seller’s control. If fraud is suspected or detected, particularly via digital means, the Seller reserves the right to interrupt or cancel the order.
In such cases, the Customer will be informed of the cancellation by email and refunded for any payments made before cancellation.
6.4 UNAVAILABLE PRODUCTS
If ordered Products are unavailable, the conditions specified in Article 3.2 of these T&Cs apply.
7 - DELIVERY
7.1 DELIVERY TERMS
The Seller delivers Products via YANGO delivery, UTB, and JUMIA. After placing the order, the Customer can change the delivery location and opt for pickup point delivery. The Seller commits to fulfilling the order.
The Customer is responsible for any consequences (delays, failed deliveries, returns, additional shipping fees, etc.) resulting from incorrect or incomplete delivery information or absence at the time of delivery.
The Seller shall not be held responsible if non-performance or improper performance of the contract is due to:
• The Customer,
• An unforeseeable and unavoidable act of a third party not involved in the contract.
The Seller will dispatch the Products to the carrier within forty-eight (48) business hours after receiving the order. However, delivery will always be made within a maximum of thirty (30) business days from the order confirmation email, subject to Product availability as indicated at the time of order.
7.2 DELIVERY DELAYS
In the event of delivery absence or delay, the Customer must contact Customer Service via https://manceraparfums.com/civ/, or by phone Monday to Sunday (excluding public holidays) at +225 07 77 77 39 71 as soon as possible.
7.3 CARRIER
Products are delivered to the address provided by the Customer on the order form. Delivery is handled by one of the above-mentioned carriers.
7.4 PRODUCT RECEIPT
Product risk transfers to the Customer upon delivery, i.e., when the Customer (or a designated third party) physically receives the Products.
Upon delivery, the Customer must inspect the order in the presence of the carrier and, if necessary, note any visible issues (missing item, damaged parcel).
If the parcel is open or visibly damaged, or if any item is missing or incorrect, the Customer (or the designated third party) should refuse delivery and clearly state detailed written reservations with the carrier.
In any case, the Customer must immediately notify the Seller using the form at https://manceraparfums.com/civ/ or by calling +225 07 77 77 39 71. This enables the Seller to initiate an investigation with the carrier and, if applicable, assert claims within legal deadlines.
If any item is missing, refused, or returned under the conditions above, the Seller will either refund the item(s) within 14 days or reship the damaged/missing item(s).
These provisions do not affect the Customer's right of withdrawal under Article 8.
7.5 DELIVERY FEES
Delivery fee: 7,000 CFA Francs.
7.6 PRODUCT RETURNS
The Customer has a right of withdrawal allowing them to return Products without justification under the conditions outlined in Article 8.
For other return reasons (damaged or non-conforming products, order error, etc.), the Customer must contact Customer Service for instructions and, if applicable, a replacement shipment.
8 - RIGHT OF WITHDRAWAL AND RETURN POLICY
8.1 GENERAL WITHDRAWAL TERMS
To exercise the right of withdrawal, the Customer must notify the decision and return the Products as follows:
The Customer has fourteen (14) days from receipt of the Products to return them.
Products must be returned in their original (sealed) packaging, complete, in perfect condition, and with the original purchase invoice.
In accordance with Law No. 2016-412 of June 15, 2016 (Consumer Code), return shipping costs are borne by the Customer.
To return Products, the Customer must first email the Seller via the form: https://manceraparfums.com/civ/, specifying the canceled order number.
The Seller commits to refunding the Customer within thirty (30) days of exercising the right of withdrawal.
For the refund, the Customer must provide their banking details. As the return is under the Customer’s responsibility, it must be sent with tracking and delivery confirmation.
8.2 LIMITATIONS TO WITHDRAWAL RIGHTS
In accordance with regulations, sealed cosmetic products are not eligible for withdrawal if unsealed by the Customer.
The Seller will not refund Products that:
• Have been damaged or altered (e.g., torn packaging, used pump), making them unfit for resale,
• Do not match the originally ordered Products.
9 - LIMITATION OF LIABILITY
The Seller shall not be held liable for failure to perform its obligations due to force majeure, the Customer’s fault or omission, an unforeseeable event involving a third party, or any circumstance beyond the Seller’s control which could not have been reasonably foreseen at the time of contract signing and whose effects could not be avoided.
10 - AFTER-SALES SERVICE
Warranty claims must be submitted primarily via email using the form at https://manceraparfums.com/civ/.
A phone line is also available Monday to Sunday (excluding public holidays): +225 07 77 77 39 71.
Products must be returned new, complete, and in their original condition and packaging after claim confirmation by the after-sales team.
11 - LEGAL GUARANTEES
All Products sold by the Seller benefit from the legal warranty of conformity and the legal warranty against hidden defects. Under these warranties, the Seller agrees to refund or replace Products that do not conform to the order, at the Customer’s choice.
12 - EXCLUSION OF WARRANTY
If the Products returned by the Customer do not match those originally ordered, the Seller shall not be bound by the above guarantees.
Legal warranties do not cover damage resulting from external causes (e.g., accidents, shocks) or Customer misuse or improper handling.
This article also does not apply if the Products were not purchased on the Site; in such cases, warranty obligations fall on the seller from whom the Products were purchased.
13 - INTELLECTUAL PROPERTY
All elements reproduced on this site are the exclusive property of the publisher and are protected by copyright, trademark, and patent law.
Any reproduction or distribution without prior written authorization from the publisher may result in legal action.
14 - PERSONAL DATA
The collection of personal information (identity, login, password, email address, phone number, billing and delivery addresses, payment methods, etc.) is mandatory for managing Customer accounts, processing and delivering orders, and issuing invoices.
Failure to provide this information will result in automatic order rejection. These data may be shared with PREMIUM DESIGN's partners, including commercial partners.
They are also stored for security purposes and legal compliance, and to improve and personalize the services and messages sent to the Customer. These data remain strictly confidential.
Depending on the Customer’s account settings, they may receive newsletters or promotional offers from PREMIUM DESIGN. If the Customer no longer wishes to receive these, they may opt out via the support form at https://manceraparfums.com/civ/ or by calling +225 07 77 77 39 71.
Data retention periods:
• 3 years: data is deleted after three years of inactivity on the website.
• 13 months: cookie consent is renewed every 13 months.
• 1–3 months: personal data correction, deletion, or return requests are processed within one to three months depending on complexity.
15 - DISPUTE RESOLUTION
15.1 COMPLAINTS
In case of a dispute related to order execution or application of the T&Cs, the Customer is encouraged to seek an amicable resolution by contacting Customer Service via https://manceraparfums.com/civ/ or by phone at +225 07 77 77 39 71 (Monday to Sunday, excluding public holidays).
If no agreement is reached, the Customer may contact the consumer mediation service.
15.2 JURISDICTION
Any dispute relating to these T&Cs shall fall under the jurisdiction of Ivorian courts, unless mandatory legal provisions assign jurisdiction to a foreign court.
16 - APPLICABLE LAW
This contract and the T&Cs governing it are subject to Ivorian law.
